The US, UK, Canada and Australia classify modafinil as a prescription drug. This label means buying it online without a prescription is technically illegal. That said, authorities very rarely pursue anyone for doing it. I’m based out of the US, have bought modafinil many times in the past, and not once have I had any issues.
Modafinil classification and legality are probably quite different in other countries. Unfortunately, I’m not aware of all the international laws which apply to this drug. If you live outside the four countries I have mentioned, you may want to look into things a bit more first.
If you are very concerned or unsure about the legality of modafinil, you can consider a related product called adrafinil. It is a prodrug to modafinil and your body has to metabolize it first. This process makes it slower acting, but once it completes, adrafinil becomes modafinil and gives the same effects.
Adrafinil is a prescription free supplement that is 100% legal to buy (though again, I can only speak for the US, UK, Canada and Australia). Other than adrafinil, there are also several other cognitive enhancement drugs which will do the trick.

At the moment, any modafinil you buy online is sourced in India and made by one of two companies: HAB Pharma or Sun Pharma. Some people may frown upon this, but these are both giant and reputable pharmaceutical firms, so there are no concerns about quality.
Indian companies do not need to respect any medical patents filed before 1995. Modafinil was patented in 1990, hence India’s ability to produce it. However, with some small exceptions, the modafinil patent expired in 2015. So, I imagine we may start seeing a bit more competition in the market soon.
If you’re trying to decide which of Sun Pharma or HAB Pharma is better, it’s six one way and half dozen the other. Both manufacture generic Provigil to the same pharmaceutical grade standards. Sun has been around longer and is more established, but compared to HAB, they also charge more for their products. I have used modafinil and armodafinil from both, and frankly, was not able to tell any difference.
For reference, Sun Pharma manufactures the products Modalert and Waklert, while the HAB Pharma equivalents are Modvigil and Artvigil. The first product listed for both manufacturers is modafinil, the second one is armodafinil.
